Panacan, Davao City – The NPAs utilization of ex-UP Diliman professor Kim Ajeas Gargar alyas Albert 34, in an attack against the government troops is a gross violation of the provision of the Comprehensive Agreement on Respect for Human Rights and International Humanitarian law (CARHRIHL).
Part 4, article 4, section 9 of CARHRIHL prohibits both Government of
the Philippines (GPH) and the National Democratic Front of the Philippines
(NDFP) as party to the agreement from allowing
the participation of civilian or civilian officials in military field
operations and campaigns. The said provision bounds both the military of
the GPH and the NPAs of the NDFP not to use civilians in the conflict. In a recorded
video statement, Gargar revealed that that he was given M16 rifle by the NPAs and
was among those who fired against the soldiers during the said clash. He
further revealed informations about the NPAs platoon Front 25 which he belongs.
Gargar is now charged with illegal possession of explosives &
firearms, violation of COMELEC gun ban and multiple frustrated murders. His
case is now at the Provincial level and detained at the Mati Provincial Prosecutor
of Mati. It is the duty of the government thru PNP to file cases against those
committed crimes. The AFP is mandated to protect the people in communities thru
security operations.
If indeed Gargar is a civilian as claimed by the NPAs and Karapatan, he
was therefore exploited by the NPAs which is a clear violation of his rights. It
can be recalled that Kim was captured by the AFP in an encounter in Brgy
Aliwagwag, Cateel, Davao Oriental on October 1. He was wounded and given first
aid care by the troops before he was brought to a hospital in Cateel.
The Team EASTMINCOM led by Lt. Gen. Ricardo Rainier G. Cruz III
condemned the NPAs deceitful way of exploiting the people especially the youth.
Lt. Gen. Cruz challenged the NPAs to embrace peace and join the government’s
peace and development programs.
