Cotabato City – Patuloy pa rin ang kontrobersya sa Department of Transportation and Communication sa Autonomousr Region in Muslim Mindanao (DOTC-ARMM) sa pagitan ni Acting Governor Ansaruddin Alonto Adiong at Director Pama P. Dimapanat sa usapin kung sino ang legal na pinuno ng departamento.
Bago pa lamang sa derektiba ni DILG Sec. Jesse Robredo sinabi ito na ipatupad at kilalanin ang legal na pinuno ng DOTC-ARMM si Dimapanat dahil sa desisyon ng korte at Civil Service Commission na kumikilala kay Dimapanat bilang legal na pinuno ng DOTC-ARMM.
Sa Panibagong derektiba ni Gov Adiong tanggalin nito sa trabaho o dropping from the rolls sila Dimapanat, Abdelnazir Mohammad Isa director 4 at Dialoson Amil dahil sa diumanoy Absent without leave (AWOL) sa loob ng mahigit isang buwan.
Sa sulat ni Robredo kay Adiong sinabi nito na "reveal that inspite of the said alleged absences from March 7, 2011 of the petitioner's they were paid of their salaries for said months, March 2011, April and May 2011 as full compensation of services rendered.This court cannot fathom of the merits of dropping of petitioners,from the rolls", ayon sa sulat ni Robredo sa desisyon ng korte na pinadala ng RTC 12 Judicial Region Branch 13 ng Cobato City noong Hunyo 21 2011.
Ayon naman sa Civil Service Commssion (CSC) na pinalabas na desisiyon na may petsang Hulyo 12, 2011 "Wherefore,the appeal filed by Pama P.Dimapanat and Abdelnazir Mohammad Isa is granted, Accordingly, the Memorandum Order No.87, series of 2011 dated May 5, 2011 issued by Acting Regional Governor Ansaruddin Alonto Adiong of the ARMM, dropping them from the rolls is declared NOT IN ORDER. ON the premise that their dropping from the rolls was implemented, they should be immediately reinstated to their post with payment of back salaries." Ayon sa desisyon ng CSC na nilagdaan nina Chairman Francisco Duque, Commissioner Mary Ann Z.Fernandez-Mendoza, Rasol Mitmug at Director IV Dolores B.Bonifacio,Secretariat and Liason Office.
Dagdag pa ni Robredo dahil sa desisyon ng korte at CSC ' it is clear that there are no more impediments on the part of Petitioner Dir. Pama Dimapanat to assume as rightful Head of DOTC-ARMM considering that the court ruled that there is no material change on the status of petitioner and the Civil Service Commimission declared not in order Memorandum No. 87 series of 2011 dropping the petitioners from rolls. Such being the case, by virtue of the departemnt's supervisory authority over autonomous region pursuant to administrative Order 273-A dated 2 December 2009, you are hereby directed to recognize the incumbency of Dir Pama P. Dimapanat as head of the DOTC-AMM".
Sa panayam kay ARMM Executive Secretary Atty. Naguib Sinarimbo ang kaso ay pinapaubaya nila sa kanilang legal counsel ang usapin. |
