ARMM Gov refuses to recognizes and implements Robredo's order on ARMM-DOTC controversy By: MARIZ REVALES
Cotabato City – Controversy on the Department of Transportation and Communication in the Autonomous Region in Muslim Mindanao (DOTC-ARMM) between Acting Governor Ansaruddin Alonto Adiong and Director Pama P. Dimapanat who is the rightful head of the mentioned department.
Department of Interior and Local Government Secreatgry Jesse Robredo issued a derective to Alonto implement and recognized Director Pama P. Dimapanat after the court and the Civil Service Commission (CSC) ruled out that recognized Dimapanat as the legal and rightful head of the DOTC-ARMM.
Gov adiong, in his new memorandum against Dimapanat was when the later was droppped from the roll togethr with director IV Abdelnazir Mohammad Isa and Dialoson Amil allegedly due to Absent without leave (AWOL).
In his letter to Adiong,Robredo quoting in part of the court decision "reveal that inspite of the said alleged absences from March 7, 2011 of the petitioner's they were paid of their salaries for said months, March 2011, April and May 2011 as full compensation of services rendered.This court cannot fathom of the merits of dropping of petitioners,from the rolls", stated in the letter from RTC 12 Judicial Region Branch 13 of Cobato City last June 21, 2011.
Also quoting the Civil Service Commission's (CSC) desicion which was issued last July 12, 2011 "Wherefore,the appeal filed by Pama P.Dimapanat and Abdelnazir Mohammad Isa is granted. Accordingly, the Memorandum Order No.87, series of 2011 dated May 5, 2011 issued by Acting Regional Governor Ansaruddin Alonto Adiong of the ARMM, dropping them from the rolls is declared NOT IN ORDER. ON the premise that their dropping from the rolls was implemented, they should be immediately reinstated to their post with payment of back salaries." Robredo's statements in the said letter which was signed by CSC Chairman Francisco Duque, Commissioners Mary Ann Z.Fernandez-Mendoza, Rasol Mitmug and Director IV, Dolores B. Bonifacio, Secretariat and Liason Office.
" it is clear that there are no more impediments on the part of Petitioner Dir. Pama Dimapanat to assume as rightful Head of DOTC-ARMM considering that the court ruled that there is no material change on the status of petitioner and the Civil Service Commimission declared not in order Memorandum No. 87 series of 2011 dropping the petitioners from rolls. Such being the case, by virtue of the departemnt's supervisory authority over autonomous region pursuant to administrative Order 273-A dated 2 December 2009, you are hereby directed to recognize the incumbency of Dir Pama P. Dimapanat as head of the DOTC-AMM", according to Robredo's letter quoting the court and CSC decision.
Meanwhile, in an interview with ARMM executive secretary Atty. Naguib Sinarimbo he admitted that they just received the letter from DILG Sec.Robredo." That issue will be taken care of our legal department and we wait for their decision",Sinarimbao said. |
